The original order LTB-L-024875-23 is set aside, and order LTB-L-017887-22 is cancelled and replaced. The tenant is ordered to pay the landlord $3,350.44 in installments, and to also pay the lawful rent in full and on time. If the tenant fails to make the payments, the landlord can apply to the Board for an order terminating the tenancy and evicting the tenant.
Considering the fact that the Tenant is making progress to paying the arrears, I find it appropriate to grant relief under section 74 of the Residential Tenancies Act.
The landlord applied for an order to terminate the tenancy and evict the tenant due to the tenant's failure to meet a condition specified in a previous LTB order regarding rent arrears.
