The Landlord's request for review was granted, as the previous order contained a serious error in the interpretation of the Notice of Rent Increase. The Landlord's application for termination and eviction due to non-payment of rent was then considered on the merits. The Tenant was ordered to pay $3,716.70 to void the eviction order and continue the tenancy, or $1,867.18 if the tenancy is terminated. The Tenant was also ordered to pay daily compensation for continued occupation of the unit.
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The application was previously dismissed, but the Landlord requested a review of the order. The review was granted, and a new hearing was held on the merits of the Landlord's application.
Landlord has reached out to Tenant on multiple occasions to make arrangements to pay the amounts owed.
Tenant has been paying an arbitrary amount of $978.89 for rent since February 2023, leading to increasing arrears.
