The tenancy will be terminated unless the Tenant pays $16,793.03 to void the order by October 21, 2024. If the Tenant does not void the order, they must vacate the unit by October 21, 2024 and pay the Landlord $10,226.74 plus daily compensation of $65.61 from August 21, 2024 until the date they vacate.
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit on the hearing date.
Landlord argued it would be unfair to grant relief from eviction as Tenant has funds to repay rent arrears but has been unlawfully withholding them.
Tenants submitted they have funds to pay rent arrears but have been withholding them due to maintenance issues, but provided no evidence to corroborate this.
Tenant failed to provide required notice and evidence to raise section 82 issues.
