The Landlord has proven on a balance of probabilities the grounds for termination of the tenancy and the claim for compensation. The tenancy is terminated effective November 5, 2024. The Tenant must pay the Landlord $12,506.50, minus any compensation or rent payments made by the Tenant, by November 5, 2024. If the Tenant does not pay the full amount owing by November 5, 2024, the Tenant will start to owe interest at 6.00% annually on the balance outstanding.
Landlord applied for an order to terminate the tenancy and evict the Tenant because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year by the Landlord's son, Ayoub Ayoub.
The Tenant stated that the Landlord's realtor told her that the son needed to move into the rental unit because he was homeless and sleeping on the floor. The Tenant also stated that the Landlord contacted her and threatened her that he explicitly told her that he wanted the son to move into the rental unit, but claims it was untrue.
