The tenancy will continue if the Tenant meets the following conditions: 1) Return the exterior of the rental unit to a state of ordinary cleanliness by September 16, 2024 and maintain it for 1 year; 2) Pay the Landlord $1,555.13 for fines and expenses in installments; 3) Not open the pool without Landlord's permission. If the Tenant fails to comply, the Landlord may apply to terminate the tenancy without notice.
Tenant agreed to pay all costs and has a plan to avoid the problem in the future
Landlord applied for an order to terminate the tenancy and evict Tenant due to Tenant's substantial interference with the Landlord's reasonable enjoyment of the residential complex. The Landlord alleged the Tenant caused an excess of refuse at the rental complex, opened the pool without permission and did not maintain it, resulting in a city work order.
Landlord doubts Tenant will comply with a conditional order, as Tenant has received multiple notices over many months and the Landlord was still receiving fines a month before the hearing.
Landlord communicated to Tenant that the garbage outside needed to be cleaned up and removed. Landlord asked Tenant not to use the pool due to safety concerns, but Tenant filled it with 'green dark water'.
Tenant requested an adjournment to gather documentation to demonstrate she has partial ownership of the rental unit and is not a tenant.
Tenant says the situation got out of hand after her friend moved in with 3 grandchildren, but the friend has since moved out. Tenant described her past living situation with other occupants as poor choices on her part.
