The tenancy is terminated unless the Tenant pays $23,916 by April 22, 2023 to void the order. If the Tenant does not pay, the Tenant must move out by April 22, 2023 and pay the Landlords $20,044.15 plus daily compensation.
Landlords applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit at the time of the hearing.
Landlord requested a standard order, stating the non-payment of rent has caused them financial hardship.
Landlord stated he hand delivered N4 notice to Tenant and made numerous attempts to negotiate a repayment plan, which were unsuccessful.
Tenant stated he did not receive N4 notice, which was refuted by Landlord's evidence. Tenant stated Landlord threw away his phone, but did not provide evidence to support this.
