The Landlord's request for eviction is denied. However, the Tenant is ordered to pay rent in full and on time for 18 months from March 1, 2025 to August 1, 2026. If the Tenant fails to comply, the Landlord may apply for termination and eviction.

Landlord applied for an order to terminate the tenancy and evict Tenant due to persistent late payment of rent. The Landlord served a valid N8 notice alleging the Tenant failed to pay rent on time for 19 consecutive months.
Landlord argued a conditional order to pay on time would be prejudicial as it would just create delay and require the Landlord to bring another application.
Landlord frequently reminded Tenant when rent was due. Landlord testified he can no longer support the property due to the financial burden caused by Tenant's late payments.
Tenant argued he never understood paying rent late was an issue, that the Landlord knew he got paid every two weeks, and that it was never a problem until recently.
Tenant paid rent late for 19 consecutive months, with increasing frequency and amount of late payments in 2024.
