The Landlord proved the grounds for termination and the claim for compensation. The Tenant shall pay the Landlord $1,026.00, which includes $840.00 for air conditioning fees from 2021-2024 and $186.00 for the application filing fee. If the Tenant does not pay the full amount by December 31, 2024, they will owe interest at 6% annually on the outstanding balance.
The Landlord's agent confirmed that the Landlord is not seeking eviction and both parties have indicated that they are prepared to negotiate a suitable payment plan.
Landlord applied for an order to terminate the tenancy and evict Tenant due to Tenant's refusal to pay additional charges for use of a unit air-conditioner. The Tenant argued that she had permission from the previous landlord to use the air-conditioner without additional charges.
Landlord argued the lease allowed them to charge for use of air-conditioner, and Tenant's continued use after notice constituted consent to pay the charges.
