The Tenant's request to adjourn the hearing was denied. The Landlord served a valid N4 Notice, and the Tenant did not void the notice by paying the arrears. The Tenant was still in possession on the hearing date. The Tenant's tenancy is terminated unless the Tenant voids the order by paying $14,884.50 by September 30, 2024 or $17,334.25 by October 31, 2024. If the Tenant does not void the order, the Tenant must vacate the unit by October 31, 2024 and pay the Landlord $10,728.19.

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit on the hearing date.
Tenant requested an adjournment to raise section 82 issues and to obtain legal advice, but the request was denied.
Tenant testified that due to his head injury, he is legally unable to work and his source of income is from Canada Pension Plan Disability and insurance. Tenant receives $1,350 per month and has monthly expenses of $1,375. Tenant stated he cannot afford the rent because he has been putting all his money towards his business, which he expects will take off soon.
