For the L1 application, the Landlord was granted an order terminating the tenancy if the Tenants fail to make the required payments towards the $18,686 in rent arrears and costs. The Tenants were ordered to make a series of lump sum and monthly payments to pay off the arrears over approximately 9 months.

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and persistent late payment of rent. The Landlord served a valid N4 notice, which the Tenants did not void by paying the arrears. The Tenants were still in possession of the rental unit at the time of the hearing.
Tenants requested a conditional order requiring monthly payment of $1,000 in addition to the monthly rent as well as periodic lump sum payments to resolve the rent arrears in approximately 9 months.
Tenants have lived in the rental unit for approximately 9 years. Tenant Ingrid Russell explained she was unable to work due to cancer and resulting treatment, which led to the rent arrears accumulating. She is now in remission and back to work.
