The Landlord has proven on a balance of probabilities the grounds for termination of the tenancy due to the Tenant's illegal acts and behavior. The tenancy is terminated, and the Tenant must move out by February 29, 2024. The Tenant owes the Landlord $8,025.68, which includes compensation for use of the unit, application fees, and the rent deposit and interest, less any payments made by the Tenant since the termination date.
Given the Tenant's limited financial resources, the termination is delayed until February 29, 2024.
Landlord applied for an order to terminate the tenancy and evict the Tenant because the Tenant or another occupant of the rental unit has committed an illegal act or has carried out, or permitted someone to carry out an illegal trade, business or occupation in the rental unit or the residential complex. The Landlord claimed compensation for each day the Tenant remained in the unit after the termination date.
Tenant testified that he doesn't think that playing music is a big deal, and that he is being shunned because he is a renter. Tenant testified that he thinks his charges will be thrown out and that his charges are not that bad.
Tenant has been arrested numerous times for the same behavior, and still his behavior continues. Tenant seems to have a blasé attitude towards his behavior, testifying that his charges were not that big of a deal.
