The Landlord's application for termination of the tenancy and eviction of the Tenant is denied, subject to the following conditions: 1) The Tenant and/or the Tenant's son shall refrain from playing music at volume level that emanates into the hallways of the residential complex; 2) The Tenant and/or the Tenant's son shall refrain from any verbal or physical altercations with the Landlord, staff of the Landlord or the Landlord's security guards; and 3) The Tenant and/or the Tenant's son shall refrain from yelling and/or screaming from the balcony of the rental unit. The Tenant shall also pay to the Landlord $186.00 for the cost of filing the application.
Landlord applied for an order to terminate the tenancy and evict the Tenant because the Tenant's occupant, his son, seriously impaired the safety of another person, a security guard, at the residential complex.
The Landlord's Legal Representative submitted that the security guard was doing his job and to be assaulted while at work is beyond the expectation of any employee. The Landlord has a responsibility to ensure that their employees are free from violence and discrimination.
The security guard testified that the Tenant's son's behaviour is ongoing despite the N7 Notice and several letters of warning.
The Tenant expressed his wishes to remain in the unit, stating that he has lived in the building for six years and would find it difficult to find alternative housing. The Tenant ensured there would be no further issues with his son.
The Tenant's son was verbally aggressive towards the security guard and attempted to punch his turban and spit in his face.
