The tenancy is terminated, and the Tenant must move out by January 28, 2023. If the unit is not vacated by that date, the Landlord may file the order with the Court Enforcement Office for enforcement.
Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year.
Landlord's parent, Ko-hsin Wang, testified that they have been alternating living with their children since arriving in Canada.
Tenant argued that she is not employed in her profession and has a young child, making it difficult to secure a new tenancy.
Tenant submitted that she had received text messages from the Landlord about demolishing the rental unit, but did not provide the messages.
