The tenancy is terminated unless the Tenant pays $35,286 by July 31, 2023 to void the order. If the Tenant does not void the order, the Tenant must pay $28,976.88 to the Landlord and vacate the unit by July 31, 2023.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.
Landlord stated he is in financial distress due to the Tenant's non-payment of rent and requires the rental income to pay the mortgage, taxes, insurance, and other carrying costs of the property. He also stated that he has three children and is caring for his aging parents.
Tenant acknowledged owing rent but disputed the amount. Tenant stated he was expecting a settlement and would be able to pay the Landlord in full.
