The tenancy continues if the Tenant meets the conditions set out in the order, including not engaging in certain behaviors for one year. If the Tenant fails to comply, the Landlord may apply to terminate the tenancy and evict the Tenant. The Tenant must pay the Landlord $186 for the application filing cost.
Landlord applied for an order to terminate the tenancy and evict Tenant due to Tenant substantially interfering with the reasonable enjoyment or lawful rights, privileges or interests of the Landlord or another tenant. The Landlord served two N5 notices for issues like unauthorized painting, verbal abuse, and inappropriate garbage disposal.
Tenant testified that after the allegations in the first and second N5's, he has been hospitalized and since his release from hospital, his behaviour has stabilized and improved. Tenant also testified that he has cleaned up the garbage in the hallway, and that he has removed the painting from the parking space and patio door of his unit.
