The tenancy will be terminated on April 30, 2024 unless the Tenants pay $25,321 to void the order and continue the tenancy. If the Tenants do not pay, they must vacate the unit by April 30, 2024 and pay the Landlord $18,168.59, which includes rent arrears, application fees, and NSF charges, minus the rent deposit and interest.
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit on the hearing date.
Landlord and Tenant had discussions about payment plans, but no resolution could be reached. Tenant offered to pay $100/month, which Landlord rejected as too prejudicial.
