The Tenant's motion to set aside the previous order is granted. The Tenant owes $8,790 in rent arrears and is given a new payment plan to pay the arrears. If the Tenant fails to make the payments, the Landlord may apply to terminate the tenancy without further notice.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after the Tenant breached a mediated settlement agreement by not paying rent on time.
Landlord opposed the Tenant's motion, arguing that the Tenant has not paid rent in full and was late paying the arrears.
Tenant argued that she did not breach the agreement because the rent bank was supposed to pay $3,200.
Tenant stated that the rent bank was supposed to pay $3,200 and that she paid $1,600 towards arrears 5 days before March 1, 2020.
