We estimate Application Date using rent arrears.
The Board granted relief from eviction subject to the Tenant paying the $489.75 in rent arrears and application fee by April 12, 2024. If the Tenant fails to make this payment or any future rent payments on time, the Landlord may apply for an eviction order without further notice. The Board also ordered the Tenant to pay rent on time going forward.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent and persistent late payment of rent. The Landlord served valid N4 and N8 notices, but the Tenant did not void the notices by paying the arrears.
Landlord did not serve documents properly, only had a verbal tenancy agreement, and did not attempt to negotiate a payment plan with the Tenant prior to the hearing as required by section 83(6) of the Act.
Tenant disputed the rent arrears amount due to a cable service dispute, but did not follow proper procedure to raise this issue.
Tenant did not disclose a list of issues they intended to raise at the hearing in accordance with section 82 of the Act.
