We estimate Application Date using rent arrears.
The Tenant shall pay the Landlords $1,006.00, which includes $820.00 in rent arrears for the period of December 10, 2021 to January 9, 2022, and $186.00 in application costs. If the Tenant does not pay the full amount by December 5, 2022, the Tenant will start to owe simple interest at 4.00% annually on the outstanding balance.
Landlords applied for an order requiring Tenant to pay the rent that the Tenant owes. The N4 Notice served to the Tenant was invalid as it only gave 13 days notice instead of the required 14 days. However, the Landlords proceeded with the application seeking the arrears only.
Landlords sought payment within 30 days, stating that the amount is not a large sum and 30 days was sufficient.
The N4 Notice served to the Tenant was invalid as it only gave 13 days notice instead of the required 14 days.
Tenant asked for 90 days to pay the amount owing, explaining that the amount was significant to him as he is on disability.
Tenant testified that the $40 claimed by the Landlords for the period of January 10, 2022 to February 9, 2022 was for a key replacement cost that the Landlords had agreed to waive from the rent.
