The tenancy is terminated unless the Tenant pays $11,307 by April 15, 2023 to void the order and continue the tenancy. If the Tenant does not pay this amount, the Tenant must move out by April 15, 2023 and pay the Landlord $8,904, plus daily compensation of $26.33 per day starting February 1, 2023 until the Tenant moves out. If the Tenant does not vacate by April 15, 2023, the Landlord may file the order with the Court Enforcement Office for enforcement.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit on the hearing date.
Landlord's Agent testified that the Landlord had been in regular contact with the Tenant since June 2022, sent reminder letters, and housing case workers had reached out to the Tenant to attempt to provide assistance.
Tenant testified that he recently found out about the N4 Notice and felt there was prejudice due to the amount of time since he received the notice. Tenant stated he is eligible for community assistance and needed to find paperwork, but it was unclear if he had applied.
