The Tenant shall pay the Landlord $1,456 in rent arrears and filing costs according to a payment plan of $100 per month from July 2022 to September 2023. The Tenant shall also pay new rent on time and in full. If the Tenant fails to make any payment, the Landlord may apply to terminate the tenancy and evict the Tenant.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit on the hearing date.
Landlord was agreeable to the Tenant's proposed payment plan.
Tenant requested a payment plan of $100 per month until the arrears are paid in full.
Tenant testified she has 4 children living in the unit, is a seasonal worker, and her average monthly income is around $2,200-$3,300.
