Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
The Tenants have not paid the total rent they were required to pay for the period from September 1, 2020 to October 31, 2021. Because of the arrears, the Landlord served a Notice of Termination effective November 24, 2020. The Tenants are in possession of the rental unit. The outstanding rental arrears to October 31, 2021 total $21,484.40. The Landlord incurred costs of $186.00 for filing the application and is entitled to reimbursement of those costs. The Landlord collected a rent deposit of $1,823.60 from the Tenants and this deposit is still being held by the Landlord. Interest on the rent deposit is owing to the Tenants for the period from January 29, 2020 to February 2, 2021. The Tenants paid $2,772.60 after the application was filed. The Tenant offered $500.00/month on top of the monthly rent payment in order to try and pay down the outstanding arrears, but the Landlord's Legal Representative did not accept this offer as it would still take more than forty-three months to pay back the arrears owing.

The tenancy is terminated effective November 15, 2021. The Tenants must pay the Landlord $18,793.23, which represents the amount of rent owing and compensation up to October 19, 2021, less the rent deposit and interest the Landlord owes on the rent deposit. The Tenants must also pay the Landlord $67.89 per day for compensation for the use of the unit starting October 20, 2021 to the date the Tenants move out of the unit, as well as $186.00 for the cost of filing the application. If the Tenants do not pay the full amount owing by November 15, 2021, they will start to owe interest at 2.00% annually on the balance outstanding. If the unit is not vacated by November 15, 2021, the Landlord may file the order with the Court Enforcement Office (Sheriff) for enforcement.
