The tenancy is terminated effective January 10, 2022. The Tenant must pay the Landlord $1,996.95, plus $32.21 per day starting December 31, 2021 until the Tenant vacates the unit. The Tenant can void the eviction order by paying $1,980.52 on or before December 31, 2021, or $2,960.18 on or before January 10, 2022.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.
Landlord's Legal Representative submitted that the Landlord would be willing to accept a payment plan of no longer that twelve months.
Landlord's Legal Representative submitted that the Tenant has not been forthcoming about her financial situation and that the proposed 52-month payment plan is far too long and prejudicial to the Landlord.
Tenant sought to preserve the tenancy by way of a payment plan to resolve the arrears.
Tenant testified that her monthly income is approximately $700.00 and proposed a payment plan of $200.00 per month to resolve the arrears.
