We estimate Application Date using rent arrears.
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
The Tenants have not paid the total rent they were required to pay for the period from December 1, 2019 to February 29, 2020. Because of the arrears, the Landlord served a Notice of Termination effective December 23, 2019. The Tenants are in possession of the rental unit. The monthly rent is $984.64. The Landlord collected a rent deposit of $14.05 from the Tenants and this deposit is still being held by the Landlord. Interest on the rent deposit is owing to the Tenants for the period from September 1, 2019 to December 23, 2019. The Tenants paid $1,590.00 after the application was filed. The parties agree that the amount outstanding to February 29, 2020, inclusive of rent arrears ($1,307.48) and costs ($175.00), is $1,482.48.
The tenancy is terminated effective September 21, 2020. The Tenants must pay the Landlord $7,564.92, which represents the amount of rent owing and compensation up to September 10, 2020, less the rent deposit and interest the Landlord owes on the rent deposit. The Tenants must also pay the Landlord $32.37 per day for compensation for the use of the unit starting September 11, 2020 to the date the Tenants move out of the unit. The Tenants must also pay the Landlord $175.00 for the cost of filing the application. If the Tenants do not pay the full amount owing on or before September 21, 2020, they will start to owe interest at 2.00% annually on the balance outstanding.
