The tenancy is terminated effective April 30, 2021. The Tenant must pay the Landlord $11,792.48 plus $43.96 per day starting March 24, 2021 until the Tenant vacates. The Tenant can void the eviction order by paying $12,158 on or before March 31, 2021 or $13,495 on or before April 30, 2021.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant remained in possession of the rental unit.
Landlord argued that the Tenant had not taken advantage of opportunities to challenge the June 2020 decision, and as a social housing provider, the Landlord could not continue absorbing the rent arrears.
Tenant requested an adjournment to challenge the June 2020 decision finding her ineligible for rent-geared-to-income (RGI) assistance, as a successful challenge could reverse or significantly reduce the outstanding arrears.
Tenant fell mentally ill in 2018 and her condition has progressed. She has tried to contact shelters and other places for alternative living accommodations but has not had any success.
