The tenancy was terminated effective February 28, 2022. The tenants were ordered to pay $3,077.86 to the landlord, which includes rent arrears up to the termination date and the cost of filing the application, minus the rent deposit and interest on the deposit. The tenants were also ordered to pay $35.92 per day for compensation for the use of the unit starting February 9, 2022 until the date they move out. If the tenants pay $5,107.94 on or before February 28, 2022, the eviction order will be void and the tenancy will continue.
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
