The tenancy is terminated effective April 18, 2021. The Tenant must pay the Landlord $6,069.97, which includes rent arrears up to the order date, compensation for use of the unit, and the application filing fee, less the rent deposit and interest owed on the deposit. If the Tenant does not pay the full amount by April 18, 2021, the Tenant will start owing interest and the Landlord can file the order with the Sheriff to enforce the eviction.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant had not paid the total rent owed for the period from July 1, 2020 to February 28, 2021.
Landlord's Agent advised that the Superintendent has had multiple conversations with the Tenant where the Tenant has made promises of payment but has not done so.
Tenant has two children and has found it difficult with COVID-19, with her children being home and added expenses. One child has had medical appointments. Tenant has had to deal with bed bugs and cockroaches, which is not sanitary for her children.
Tenant did not provide the required advance notice under Section 82 of the Residential Tenancies Act to raise issues such as bed bugs and cockroaches.
