The Tenants shall pay the Landlord $8,606.00 for arrears of rent up to January 31, 2023 and costs, in accordance with a payment schedule over 17 months. If the Tenants fail to make any one of the payments, the outstanding balance shall become immediately due and owing, and the Landlord may apply to the LTB for an order terminating the tenancy and evicting the Tenants.
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit on the hearing date.
The Landlord does not believe the Tenants will be able to maintain the monthly payments toward arrears.
The Tenants have proposed to pay $500.00 monthly toward the rent arrears.
