The tenancy is terminated unless the Tenant pays $14,037.75 by February 29, 2024 or $15,593.70 by March 3, 2024 to void the order and continue the tenancy. If the Tenant does not void the order, they must pay $10,800.20 to the Landlord and vacate the unit by March 3, 2024. If the unit is not vacated, the Landlord may file the order with the Sheriff for enforcement.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant was still in possession of the rental unit on the hearing date.
Tenant argued that their health care circumstances 'flare up' during the winter months and requested a payment plan or three month's delayed conditional termination.
