The tenancy between the Landlord and Tenants was terminated as of August 27, 2021 when the Tenants vacated the rental unit. The Unauthorized Occupant, Gareth D'Costa, is ordered to move out of the rental unit by November 4, 2021. If the unit is not vacated by that date, the Landlord may file the order with the Sheriff to remove the Unauthorized Occupant. The Unauthorized Occupant is ordered to pay $1,000 in costs to the Board.
Landlord applied for an order to terminate the tenancy of the Tenants and remove an unauthorized occupant, Gareth D'Costa, who had moved into the rental unit without the Landlord's consent.
Landlord was unable to rent the unit to new tenants due to the Unauthorized Occupant's refusal to vacate.
Tenants allowed Unauthorized Occupant to move in and paid him $1,000 to do so.
