The tenancy is terminated unless the Tenant pays $25,580 by March 31, 2023 or $27,993 by April 30, 2023 to void the order. If the Tenant does not void the order, the Tenant must move out by April 30, 2023 and pay the Landlord $23,205.12 plus daily compensation of $79.33 from March 16, 2023 until the Tenant moves out.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit on the hearing date.
Tenant is unemployed, has a high-risk pregnancy, and has a minor child living in the rental unit. Tenant has applied to approximately 20 other units but has not found alternative accommodation due to high rents.
Tenant did not provide the required notice and description of issues under Section 82 prior to the hearing.
