The tenancy is terminated effective September 10, 2021. The Tenant must pay the Landlord $16,933.44 in rent arrears and application costs, less the rent deposit and interest. If the Tenant does not pay by September 10, 2021, the Landlord may file the order for enforcement of the eviction.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant had vacated the rental unit on December 1, 2020, prior to the hearing date.
Tenant argued N4 Notice was defective for not naming a second tenant, but failed to provide evidence of this second tenant.
Tenant claimed to have vacated on December 1, 2020, but Landlord's representative testified Tenant was still observed at the unit after that date.
