The tenancy is terminated effective July 16, 2021. The Tenant must pay $4,574.40 to the Landlord, which includes rent arrears up to the termination date, compensation for use of the unit, and the application filing fee, less the rent deposit and interest owed on the deposit. If the Tenant pays $6,631 by June 30, 2021 or $8,081 by July 16, 2021, the eviction order can be voided and the tenancy can continue.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.
Landlord attempted to negotiate a repayment agreement with Tenant.
Tenant requested a payment plan but did not provide details, and requested more time to vacate the unit.
Tenant fell into arrears due to job loss at start of pandemic, prioritized other payments over rent, and only received a phone call from Landlord about a repayment agreement.
