The tenancy is terminated unless the Tenant pays $22,195.28 by December 31, 2022 or $24,214.22 by January 31, 2023 to void the order and continue the tenancy. If the Tenant does not void the order, they must pay $17,166.18 to the Landlord and vacate the unit by January 31, 2023.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant was still in possession of the rental unit on the hearing date.
Landlord's Agent submitted that the Tenant has made no effort to pay the rent in full since October 2021 or make any payments towards the rent arrears.
Landlord's Agent submitted that the Tenant's payments have been minimal and the current rent arrears are substantial, making a payment plan prejudicial to the Landlord.
Tenant requested relief from eviction in the form of a repayment plan or a 2-month postponement of the eviction.
Tenant testified he has recently secured a full-time job and proposed a repayment plan of keeping the rent current and paying $1,000 on the 20th of each month.
