The tenancy is terminated effective September 30, 2021. The Landlord shall pay interest on the rent deposit to the Tenants for the period from August 10, 2017 to September 30, 2021. The Tenants shall pay the Landlord $31.23 per day for compensation for the use of the unit from September 30, 2021 to the date they move out of the unit. If the unit is not vacated on or before September 30, 2021, the Landlord may file the order with the Court Enforcement Office (Sheriff) so that the eviction may be enforced.
Landlord applied for an order to terminate the tenancy and evict Tenants because the Landlord requires possession of the rental unit for the purpose of residential occupation. The Landlord also claimed compensation for each day the Tenants remained in the unit after the termination date.
The Landlord testified that he is an 80 year-old senior citizen and wishes to use the basement apartment to convert it to a temple so he can worship in his own house as he is sometimes unable to go to temples due to his age. He stated that at his age he has no plans to re-rent basement apartment after these tenants have vacated.
The Tenants believe there is another room in the houses that could be used for the temples. The Tenants state that previously the Landlord said he needed the unit for his niece but that was not a valid N12 and so now he is saying he needs it for is own use.
