The Landlord's application for termination of tenancy and eviction of the Tenant for personal use was granted. The tenancy is terminated as of April 30, 2022, with the Tenant required to vacate by that date. The Landlord may file for eviction enforcement starting May 1, 2022, if the unit is not vacated.
Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord requires possession of the rental unit for the purpose of residential occupation by their son.
Landlord argued that their son, now 21 years old, wants to have a place of his own and intends to live in the upstairs three-bedroom unit with two friends.
Landlord did not increase the rent for seven years since 2009. Landlord paid the Tenant compensation equal to one month's rent.
Tenant argued that the Landlord's request to increase rent was a sign of bad faith. Tenant also claimed that the Landlord's son had knee surgery and would have problems with the stairs to the upper floor unit.
Tenant did not find alternative accommodations because they were going to challenge the Landlord's application.
