The tenancy is terminated effective April 15, 2023. If the unit is not vacated by that date, the Landlord may file the order with the Court Enforcement Office (Sheriff) for enforcement.
Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year by the Landlord's mother.
Landlord testified that they intend to have the Landlord's mother move into the rental unit for no less than one year. The Landlord's witness, the mother, also testified that she intends to move into the rental unit for no less than one year.
The certificate of service indicated the N12 notice was 'placed at the base of front door and held in place with a rock', which is not an approved method of service.
Tenant takes the position that the Landlord served the N12 notice in bad faith, merely wanting to increase the rent via a new tenancy, and that the Landlord's mother will not move into the rental unit.
Tenant said she has looked for alternative housing and visited 4-5 properties, but they did not meet her needs. She said she does not have family or friends who could assist with temporary accommodation.
