File Number: HOL-10827-21
Hearing Date

Order Date
Oct 29, 2021
Tenancy End Date
Nov 2021
The tenancy is terminated, and the Tenant must move out of the rental unit on or before November 9, 2021. The Tenant shall pay the Landlord $1,944.23, which represents compensation for the use of the unit from September 2, 2021 to October 29, 2021, less the rent deposit and interest the Landlord owes on the rent deposit. The Tenant shall also pay the Landlord $72.33 per day for compensation for the use of the unit from October 30, 2021 to the date the Tenant moves out of the unit, and $186.00 for the cost of filing the application.
Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord requires possession of the rental unit for the purpose of residential occupation.
The Landlord is currently living at home with his father and has decided to move into the rental unit to reside there permanently.
The commute from the rental unit to the Landlord's place of work is longer than from the Landlord's current place of residence. The Landlord's initial intention was to sell the home when the Tenant did not vacate after receiving the N12 notice of termination. The Tenant has filed a T6 application with the Board to hear her maintenance claim.
