Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenants did not void by paying the arrears.
The Tenants' request for a review was granted as they were not reasonably able to participate in the previous proceedings. The Landlords' L1 application was then heard de novo. The Tenants owed $19,821.97 in rent arrears as of January 31, 2022, and the total amount owed including the filing fee was $19,996.97. The tenancy was terminated effective February 28, 2022 if the Tenants did not pay $21,135.55 to void the eviction order and continue the tenancy. If the Tenants did not make this payment, the Landlords could file the order with the Court Enforcement Office to enforce the eviction.
