Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice of Termination, which the tenant did not void by paying the arrears.
The Tenant is a person with a disability who fell into arrears when he transitioned from the Ontario Disability Support Program to the Canada Pension Plan upon turning 65 years of age. Although the payment plan is longer than the Landlord would like, the prejudice to the Landlord is far less significant than the prejudice to the Tenant who would face great hardship as a senior citizen on a low fixed income with a disability during a pandemic.
