The tenancy is terminated effective June 20, 2021, unless the Tenant pays the full amount owing by the deadlines provided. The Tenant must pay $5,512.95 in rent arrears and application costs, plus $23.47 per day in compensation starting May 6, 2021 until the Tenant vacates. If the Tenant does not pay the full amount by the deadlines, the Landlord may file the order with the Sheriff for enforcement.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant was in possession of the rental unit on the application date.
Landlord's agent stated she had sent written correspondence to Tenant 4 times after filing application to try to resolve, and had a conversation with Tenant in February 2020, but Tenant denied receiving any correspondence or having such a conversation.
Tenant disputed the total amount of arrears, stating she never received relevant rent re-calculation notices and that the Landlord made errors in re-calculating her rent.
Tenant testified she was not employed and could only afford $100 per month towards arrears, which would take 52 months to pay off. Tenant has resided at the unit for 20 years and has adult daughter and 3-year-old granddaughter living with her.
