The tenancy is terminated unless the Tenant pays $14,386 by May 31, 2023 or $16,161 by June 11, 2023 to void the order. If the Tenant does not void the order, they must pay $11,069.44 to the Landlord and vacate the unit by June 11, 2023. The Tenant will also owe $58.36 per day in compensation for use of the unit starting May 5, 2023.
Landlords applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit on the hearing date.
Tenant suggested the N4 notice and application were defective because they did not list the Tenant's legal name.
Tenant explained the impact of the application and poor landlord-tenant relationship on the Tenant and their family. Tenant also submitted that the Landlord does not properly maintain the rental unit.
