The tenancy is terminated. The Tenant must move out of the rental unit on or before September 30, 2022. If the unit is not vacated by that date, the Landlord may file the order with the Court Enforcement Office (Sheriff) to enforce the eviction.
Landlords applied for an order to terminate the tenancy and evict Tenant because the Landlords in good faith require possession of the rental unit for the purpose of residential occupation for at least one year.
Landlords proved on a balance of probabilities the grounds for termination of the tenancy.
Landlords claim they require the unit for their own residential occupation. They denied demanding a higher rent from the Tenant.
Tenant argued the application was brought in retaliation for attempting to secure her legal rights.
Tenant disputed that Landlords were going to move into the unit, and believed the application was in retaliation for Tenant resisting a rent increase.
