Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
The Landlord's right to claim an amount of rent arrears in excess of the Board's $35,000.00 monetary jurisdiction is extinguished, pursuant to subsection 207(3) of the Residential Tenancies Act, 2006 (the 'Act'). If the Tenants do not pay the full amount by October 31, 2021, the Landlord may file the order with the Sheriff to enforce the eviction.
