The Landlords' application was dismissed as the N4 notice of termination was found to be defective.
Landlords applied to terminate the tenancy and evict Tenants due to non-payment of rent. The parties had a rent-to-own agreement, and there was a dispute over the lawful monthly rent amount.
The Landlords submitted that the monthly rent amount is $3,700.00 per month.
The N4 notice of termination did not comply with the Residential Tenancies Act as it claimed an additional amount that was not rent.
The Tenants' Agent submitted that the monthly rent is $2,230.00 per month, not $3,700.00 per month as shown on the N4 Notice, and that the Landlords cannot include property taxes, insurance and down payment amounts as these payments are not part of the lawful rent.
