The tenancy is terminated as of November 30, 2021, to give the Tenant time to secure alternative accommodation with the assistance of social housing agencies. If the unit is not vacated by November 30, 2021, the Landlords may file the order with the Court Enforcement Office (Sheriff) for enforcement starting December 1, 2021.
Landlords applied for an order to terminate the tenancy and evict Tenant because the Landlords have entered into an agreement of purchase and sale of the rental unit and the purchaser requires possession of the rental unit for the purpose of residential occupation.
Landlords served a valid N12 notice to the Tenant, with a termination date of September 30, 2021. The purchasers, Emmanuel Uzu and Omoye Uzu, have an agreement with the Landlords to purchase the rental unit and they in good faith require possession of the rental unit for the purpose of residential occupation.
Tenant is the custodial, single parent to 3-year-old and 12-year-old children. She was working as a nurse but has been unable to do so due to the demands of the children. Her sole source of income is social assistance. She has been asking for documentation to support her application for social housing, but it has not been forthcoming from her previous landlords.
