Citation: Andric v Peterson, Declerck, 2021 CanLII 140714 (ON LTB)
File Number: SOL-21842-21-HR
Application Date (Estimate)
Jun 2021
Hearing Date
Aug 2021
Order Date
Oct 5, 2021
Tenancy End Date
Oct 2021
We estimate Application Date using rent arrears.
The tenancy is terminated effective October 16, 2021. The Tenants must pay the Landlord $3,461.79, which includes rent arrears up to the termination date and the cost of filing the application, less the rent deposit and interest on the deposit. The Tenants must also pay $50.27 per day for compensation for use of the unit starting October 6, 2021 until they move out. If the Tenants do not pay the full amount by October 16, 2021, the Tenants will start owing interest and the Landlord can file the order with the Sheriff to enforce the eviction.
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
Tenants have a history of not paying rent on time or at all, and the problem continued despite previous mediation attempts.
