The request to review order TSL-08851-19 issued on January 20, 2020 was heard and the order is confirmed and remains unchanged. The interim order issued on February 28, 2020 is cancelled and the stay of order TSL-08851-19 is lifted immediately.
Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord requires possession of the rental unit for the purpose of residential occupation. The Tenant requested a review of the order and that the order be stayed until the request to review the order is resolved.
The Landlord wanted this unit for the use of his elderly parents because it was next door to his own home, and thus convenient for him to assist them. His own home was not suitable for sharing with his children, wife and parents. His parents needed their own quiet space.
The Tenant alleged that the Order contained a serious error because the presiding Member had not considered an audiotape which he had, in fact, submitted in accordance with deadlines set by the Board.
