The tenancy is terminated effective June 22, 2021. The Tenant must pay the Landlord $15,405.70 (less any payments made after October 28, 2020), plus $28.77 per day starting June 12, 2021 until the Tenant vacates. If the Tenant pays $17,025.00 (less any payments made after October 28, 2020) by June 22, 2021, the eviction order will be void and the Tenant can remain in the unit.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.
Landlord's agent stated they have not received keys to the unit or any notice that the Tenant has or intends to vacate, and occupants were seen in the unit as recently as October 23, 2020.
Tenant stated she was no longer in the unit but had some possessions still there. She did not agree with the rent arrears amount but her receipts were packed up. Tenant said she did not pay rent for September and October 2020 to secure a new apartment.
