Dispute Summary

Landlord applied for an order to vary the percentage rent reduction determined under section 132 of the Residential Tenancies Act, 2006 because the municipal property taxes in respect of the residential complex were changed after the Notice of Rent Reduction was issued by the City of Toronto.

Determinations

• The Board received submissions from the Tenants. In their submissions, the tenants raise maintenance issues. These submissions were taken into consideration to the extent we can under the legislation. The Landlord's reply was also taken into consideration.
• The Certificate of Service filed by the Landlord on September 28, 2022, indicates that some rental units listed in the application were not served with the application and notice of hearing. The Board shall therefore amend the application by removing these rental units.
• The municipal property taxes in respect of the residential complex were changed after the City of Toronto issued the notice of rent reduction. Therefore, pursuant to section 132 of the Act and subsection 42(1)(d) of O.Reg 516/06, the Landlord is entitled to an order varying the percentage rent reduction determined by the City of Toronto.
• The percentage rent reduction set out in the notice of rent reduction issued by the municipality should be varied.
